The Colorado Independent: Pot Trial Ends In Settlement

    What is the law? If police officers are still arresting people for possession, and the defendants are still being handcuffed, booked and charged with a criminal offense, possession remains illegal, doesn't it? Is the police force using the paraphernalia charge to sidestep the inevitable city vs state trial?
    I know it's not the responsibility of the defendant to test the limits of a new policy, but is someone going to have to take a possession case all the way to the state supreme court before we know if possession is legal in Denver?

    To give you a quick answer: probably. Although I don't know if such a case would go all the way to the supreme court.
