There are checks in place at both levels to prevent the minority from being gagged, as it were.<br><br>However, referendums to amend state constitutions are legal in many of the states, so in this case the majority does "rule," though only if the measure actually makes it to the ballot. How about the citizens of California, Michigan and Washington understood exactly what they were voting for. They object to racial preferences.
